THE REGISTER OF DEEDS   for Gates County, North Carolina


Instrument Recording Standards
         

Effective July 1, 2002, all instruments presented for registration, for which a fee is collected under North Carolina General Statutes (NCGS) 161–10(a), shall meet all of the following requirements  

  1. Be on paper 8 1/2 inches by 11 inches or 8 1/2 inches by 14 inches.
  2. Have a blank margin of three inches at the top of the first page and blank margins of 1/2 inches on the remaining sides of the first page and on all sides of subsequent pages. All exhibits and attachments to documents  must also comply.
  3. Be typed or printed in black and white paper in a legible font. A font size no smaller than 10 points shall be considered legible. Blanks in an instrument may be completed in pen (printed) and corrections to an instrument may be made in pen.
  4. Have text typed or printed on one side of a page only.
  5. State the type of instrument at the top of the first page.

If an instrument does not meet these requirements, the register of deeds shall register the instrument after collecting the fee of $25.00 for nonstandard documents as required by GS 161-101(a) (19) in addition to all other applicable recording fees.

Effective February 1, 2004, all deeds presented for recording in Gates County must first be taken to the tax office to be checked for delinquent taxes.  When cleared, the tax office will affix a stamp to that effect and the deed(s) may then be presented for recording.  This resolution was signed by the Gates County Board of Commissioners on January 5, 2004.
